11/15/2024 - PAPERLESS ORDER granting 75 Unopposed Motion to Continue the Show Cause Hearing. The Preliminary Injunction and Show Cause hearing set for December 10, 2024, shall be reset for January 6, 2025, at 2:00 p.m. We find good cause to extend our ex parte Statutory Restraining Order [ECF No. 10 ] until January 6, 2025, as the parties have various conflicts throughout the month of December and all (but one) of the parties consent to the SRO's extension. We acknowledge that Defendant Holton Biggs' does object. See Motion at 2 ("[Biggs] opposes the extension of any further ex parte relief."). But Defendant Biggs has a pending motion to dismiss where he asks us to stay our statutory restraining order as soon as possible. See Motion to Dismiss [ECF No. 76] at 34 ("Defendant Buggs' motion to stay requires emergency consideration because of the irreparable harm that he is now suffering due to the receivership and the SRO, and because his businesses unrelated to TD are at increasing risk of financial distress and collapse with each passing day that the receivership and SRO are in effect. For these reasons, Defendant Buggs requests a ruling on his motion to stay as soon as possible."). We'll address Biggs's request for a stay once the Plaintiff has filed its response.
