CFTC’s Energy and Environmental Markets Advisory Committee Releases Agenda for Upcoming Public Meeting
Washington, DC — The U.S. Commodity Futures Trading Commission (CFTC) announced today the full agenda for the upcoming CFTC Energy and Environmental Markets Advisory Committee (EEMAC) public meeting. The meeting will be held on Thursday, February 25, 2016, at the CFTC’s headquarters in Washington, D.C. from 10:00 a.m. to 1:30 p.m. For more information regarding the meeting, view CFTC Press Release 7325-16.
The EEMAC will consider the CFTC’s approach to exempting electricity transactions that take place on highly regulated markets administered by regional transmission operators (RTOs) and/or Independent System Operators (ISOs), such as the Southwest Power Pool, with a particular focus on the proposed inclusion of private rights of action in these orders.
“Congress intended that the CFTC work closely with the Federal Energy Regulatory Commission (FERC) and state regulators to harmonize and streamline our regulation of this vitally important sector, and the EEMAC will provide an invaluable evaluation of our progress in this endeavor,” said CFTC Commissioner J. Christopher Giancarlo, the sponsor of the EEMAC.
“In addition, the EEMAC will carefully examine the CFTC Staff Preliminary Report on the Swap Dealer De Minimis Exception, which is of great concern to the energy and environmental markets, and suggest ways the CFTC can avoid damaging already fragile energy markets in setting its de minimis threshold.
“Finally, for the first time in six years, the EEMAC will exercise its statutory authority, pursuant to the Dodd-Frank Act, to submit a report and recommendations to the CFTC,” Giancarlo added.
