CFTC Announces Appointments of Terry Arbit as Deputy General Counsel for Regulation and Administration and Brad Berry as Deputy General Counsel for Litigation

Washington, D.C. – The Commodity Futures Trading Commission (CFTC) announced today the appointments of Terry Arbit as Deputy General Counsel for Regulation and Administration and Brad Berry as Deputy General Counsel for Litigation. Mr. Arbit’s appointment is effective immediately.

In announcing these appointments, Chairman Jeffery said,

“The Commission is extremely fortunate to have Terry and Brad in the Commission’s Office of General Counsel. With their broad legal backgrounds, unique skills, and demonstrated leadership qualifications, I am positive the Commission will continue to receive legal counsel and representation of the highest caliber.”

Mr. Arbit has served the Commission in a number of capacities since 1996, most recently as Counsel to the Chairman, providing the Chairman’s Office with legal advice and policy analysis on statutory and regulatory initiatives. Before joining the CFTC, Mr. Arbit was Counsel in the Professional Liability Section of the Resolution Trust Corporation and the Federal Deposit Insurance Corporation (FDIC). Prior to his government service, Mr. Arbit was a litigator in private practice in Chicago, Illinois.

Mr. Arbit received joint M.A. and B.A. degrees in 1980 from the University of Pennsylvania (Summa Cum Laude) and his Juris Doctor degree from the University of Chicago Law School in 1983. After graduating from law school, Mr. Arbit clerked for the Honorable Charles L. Levin of the Supreme Court of Michigan.

Mr. Berry comes to the CFTC from Wilmer Cutler Pickering Hale and Dorr LLP, where he is a partner and a member of the firm’s Litigation Group as well as its Communications and Electronic Commerce Practice Group. Prior to joining Wilmer Cutler, Mr. Berry was a partner with Nixon Peabody LLP, and a member of the firm’s litigation group. He represented individuals, corporations, and partnerships in civil and administrative litigation. Before joining Nixon Peabody LLP, Mr. Berry held numerous local and federal government positions, including, among others, Counsel to the Deputy Attorney General, U.S. Department of Justice and Deputy Chief, Enforcement Bureau, Federal Communications Commission (FCC). Prior to joining the FCC, Mr. Berry was a partner at Miller, Cassidy, Larroca & Lewin LLP.

Mr. Berry received his B.A. degree in 1985 from The George Washington University (with distinction, Phi Beta Kappa) and his Juris Doctor degree in 1988 from Yale Law School where he was selected as a John M. Olin Fellow in Law, Economics and Public Policy. After graduating from law school, Mr. Berry clerked for the Honorable Nathaniel R. Jones, United States Court of Appeals for the Sixth Circuit.
