CFTC Commissioner Dan Berkovitz Announces Staff Appointments

Washington, DC — Commodity Futures Trading Commission (CFTC) Commissioner Dan Berkovitz announced that Erik Remmler will serve as Chief of Staff and Lucy Hynes will serve as Special Counsel.

Commissioner Berkovitz commented:  “I am very glad to have Erik and Lucy on my team.  They both have extensive experience at the CFTC and in the private sector.  I am confident that together we will help advance the CFTC’s mission by contributing perspectives on regulatory issues that will complement and further the CFTC’s existing efforts.”

Erik Remmler, Chief of Staff

Erik Remmler joined the CFTC in 2010, after 18 years practicing law in the capital markets.  Prior to joining the office of Commissioner Berkovitz, Erik served as Deputy Director in the CFTC’s Division of Swap Dealer and Intermediary Oversight.  In that role, he supervised the branch responsible for registration and compliance of intermediaries including, in particular, swap dealers.  Erik led the day-to-day implementation of swap dealer regulation; drafted numerous regulations and amendments, no action letters and advisories; and provided guidance to the Commission and market participants.  Erik’s branch undertook the first in-depth analysis of swap data repository data to assess the extent of dealer registration and dealer market coverage.  Erik managed the CFTC’s Volcker Rule activities since adoption of the regulations.  In addition, Erik played leading roles in drafting numerous regulations since adoption of the Dodd-Frank Act relating to swap dealer registration and regulation, mandatory clearing, and the Volcker Rule.

Prior to joining the CFTC, Erik practiced law at major law firms with a focus on over-the-counter derivatives and structured finance transactions.  In that capacity, he developed new derivative products and financing structures and negotiated over a thousand ISDA agreements; many in connection with complex financings. 

Erik received a B.A. from the University of Chicago and a J.D. from Pace University School of Law.

Lucy Hynes, Special Counsel

Lucy Hynes joins Commissioner Berkovitz’s office from the CFTC’s Division of Enforcement (DOE), where she served as a Senior Trial Attorney.  In DOE, Lucy conducted investigations into potential violations of the Commodity Exchange Act and Commission Regulations, represented the Commission in federal district court litigation, and negotiated resolutions with financial institutions and individuals.  Lucy also co-chaired the Insider Trading Task Force, where she developed tools to enhance the detection and prosecution of insider trading cases.

Prior to joining the CFTC, Lucy practiced law at Ropes & Gray LLP, where she represented financial firms, public companies, and individuals in private securities litigation and in enforcement matters before the DOJ, SEC, NFA, FINRA, and futures exchanges.  Lucy received a B.A. from the University of Virginia and a J.D. from the American University Washington College of Law.
